1. Agreement
By accessing or using this website ("Site"), you agree to these Terms of Service. If you do not agree, do not use the Site. Paid project engagements are governed by a separate Statement of Work; in case of conflict, the SOW prevails for that engagement.
2. Eligibility
You must be at least 16 years old and legally able to enter into a binding contract to use this Site or engage our services.
3. Acceptable use
You agree not to: (a) misuse the Site or interfere with its operation; (b) attempt unauthorized access; (c) scrape or harvest content for commercial use without permission; (d) upload malicious code; (e) impersonate another person; or (f) use the Site to violate any law.
4. Accounts
You are responsible for keeping your account credentials secure and for all activity under your account. Notify us immediately of any unauthorized access. We may suspend or terminate accounts that violate these Terms or that are used for abuse, fraud, or chargebacks.
5. Digital products & license
Guides, the Social Media Bundle, the prompt library, and Get Unstuck sessions are digital products delivered through this Site. When you buy a downloadable guide or bundle, you receive a personal, non-transferable, non-exclusive license to use it for your own business or study. You may not resell, redistribute, sublicense, publish, or share the files or their contents (including copying prompts into publicly distributed products) without prior written permission.
6. Payments
All payments are processed by Stripe. Prices are listed in USD unless stated otherwise and may change at any time; the price at checkout is the price you pay. Applicable taxes are added by Stripe based on your location. See our Refund Policy for what is and isn't refundable.
7. Get Unstuck sessions
A Get Unstuck session is a paid 1:1 consult. You pay when you submit your request. If we cannot help or cannot schedule you within our published window, we issue a full refund. Confirmed sessions are subject to our Refund Policy.
8. Intellectual property
All Site content — including copy, designs, graphics, code, logos, and trademarks — is owned by Nambi or its licensors and is protected by intellectual-property laws. You may not copy, modify, distribute, sell, or reverse-engineer Site content without prior written permission. Limited personal browsing is permitted.
9. Client work & deliverables
Ownership and license of deliverables produced under a paid engagement transfer on full payment, as specified in the applicable Statement of Work. Nambi retains the right to display deliverables in a portfolio and case studies unless the SOW says otherwise.
10. DMCA / copyright complaints
If you believe content on this Site infringes your copyright, send a notice to [email protected] including: identification of the copyrighted work, the URL of the allegedly infringing material, your contact information, a good-faith statement, a statement under penalty of perjury that you are the owner or authorized to act, and your physical or electronic signature.
11. Third-party links & content
The Site may link to third-party sites or include embedded content. We do not control and are not responsible for third-party content, policies, or practices.
12. Disclaimers
The Site and all content are provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or secure.
13. Limitation of liability
To the maximum extent permitted by law, Nambi shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, data, or goodwill arising out of your use of the Site. Our aggregate liability arising from your use of the Site is limited to USD $100.
14. Indemnification
You agree to indemnify and hold Nambi harmless from any claim or demand, including reasonable attorneys' fees, arising out of your breach of these Terms or your violation of any law or third-party rights.
15. Termination
We may suspend or terminate your access to the Site at any time, for any reason, without notice.
16. Governing law
These Terms are governed by the laws of the State of New York, United States, without regard to conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Site will be resolved exclusively in the state or federal courts located in New York County, New York, and you consent to the personal jurisdiction of those courts. Nothing in this section limits any non-waivable statutory rights you may have as a consumer in your country of residence.
17. Changes
We may update these Terms from time to time. Continued use of the Site after changes constitutes acceptance of the updated Terms.
